These terms apply when you use Own Ahead. By creating an account, browsing listings, sending an inquiry, submitting a listing or claim, or subscribing to Own Ahead Pro, you agree to them. If you do not agree, please do not use the service.

1. Eligibility and your account

  • You must be at least 18 years old and able to enter a binding agreement.
  • You are responsible for the accuracy of the information you give us and for keeping it up to date.
  • You are responsible for your account credentials and for everything that happens under your account. Tell us promptly if you suspect unauthorised access.
  • You may not share, resell or transfer your account or Pro access.

2. What Own Ahead is — and is not

Own Ahead is a marketplace, search, information and analytics service only. Own Ahead is not a real estate broker or agent, lender, mortgage broker, loan originator, loan servicer, title company, escrow company, appraiser, insurer, attorney, tax adviser or financial adviser.

Using Own Ahead does not create an agency, brokerage, fiduciary, advisory or attorney-client relationship. We do not represent you in a transaction, do not negotiate on your behalf, and do not originate, underwrite, service or guarantee any financing.

3. Listing and financing information

Listings, financing descriptions, prices, terms, photographs, placeholders, availability and property characteristics come from sellers, representatives, partners and third-party sources. That information may be incomplete, inaccurate, out of date, withdrawn, changed or unavailable at any time.

Own Ahead does not guarantee any of the following:

  • That a property exists as described, or that its condition, size, age, or characteristics are accurate.
  • Ownership, title status, liens, encumbrances or legal compliance.
  • That the person offering the property has authority to sell it or to offer financing.
  • That any advertised financing is available, remains available, or will be offered on the stated terms.
  • That you will be approved, that credit or income criteria will be met, or that any transaction will close.

A “source checked” date means the underlying source was reviewed on that date. It does not mean Own Ahead independently verified the facts in the listing. See the marketplace disclaimer.

4. Seller financing is regulated

Seller financing, owner financing, lease-to-own arrangements and mortgage assumptions are subject to federal and state law, which can include lending, licensing, disclosure, servicing, usury, consumer-protection and recording requirements. You are responsible for using qualified professionals — an attorney, title company, licensed lender or loan originator where required, tax adviser and a licensed loan servicer — to structure, document, disclose, record and service any arrangement in compliance with applicable law. Own Ahead does not provide those services and does not assess whether a particular arrangement is lawful.

5. Estimates, calculators and scores

Payment estimates, tax and insurance approximations, affordability figures and the Own Ahead Score and Own Ahead Finance Advantage estimates are informational comparisons generated from posted data and general assumptions. They are not offers, quotes, appraisals, underwriting decisions, recommendations, or financial, legal or tax advice, and actual costs and terms will differ.

6. Your independent due diligence

Before committing to anything you find through Own Ahead, you should obtain:

  • A professional inspection and, where relevant, an appraisal.
  • A title search and review of liens, easements and encumbrances, plus title insurance.
  • Current property tax, insurance and utility cost figures.
  • Zoning, permit, code, flood and survey information.
  • HOA documents, dues and restrictions where applicable.
  • Legal review of the purchase contract, note, deed of trust or mortgage, lease-option agreement and all disclosures.
  • Confirmation of financing terms, servicing arrangements and payoff obligations directly with the seller or lender.

7. Third-party sources and links

Own Ahead may reference or link to third-party sources, websites and services. We do not control or endorse them, are not responsible for their content or availability, and your dealings with them are between you and them. Third-party listing content, including text and images, remains the property of its rights holder.

8. Own Ahead Pro

Own Ahead Pro is a paid subscription that unlocks additional private listing detail subject to a server-side entitlement check. Pricing, auto-renewal, promotion codes, cancellation, failed payments and refunds are governed by the subscription and billing terms, which form part of these terms.

9. Listing claims

  • By submitting a listing claim you certify that you are the owner, the listing agent or broker, or another authorised representative for that property, and that everything in your claim is accurate.
  • Submitting a false, misleading or unauthorised claim is prohibited and may result in removal, suspension and referral to the relevant licensing authority.
  • We may request further evidence, decline a claim, or withdraw an approval at any time.
  • An approved claim shows only that the claimed relationship and identity were reviewed. It is not verification of the property, its title, its condition, or any financing or transaction.

10. Content you submit

You keep ownership of the listing details, descriptions, notes, images and other content you submit. You grant Own Ahead a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for formatting, and display that content solely to operate, promote and improve the service, including in search results and listing pages. You warrant that you hold the rights and permissions needed to submit the content and to grant this licence, and that the content is lawful and not misleading.

11. Prohibited conduct

  • Scraping, crawling, bulk downloading, indexing or systematically extracting listings or other content.
  • Circumventing, disabling or interfering with paywalls, entitlement checks, gating of private data or rate limits.
  • Reverse engineering, decompiling or probing the service other than through our responsible disclosure process.
  • Submitting false listings or false listing claims, or impersonating any person, agent, broker or entity.
  • Harassment, threats, abusive conduct or discrimination against any user, seller or representative.
  • Discriminatory listings, filtering, statements or communications — see the fair housing policy.
  • Unlawful lending, brokering, advertising or loan-origination conduct.
  • Collecting personal information about other users without authorisation, or using contact details we release for spam, marketing lists or resale.
  • Sharing credentials, using automated accounts, or otherwise abusing free or paid access.
  • Uploading malware, interfering with the service's operation, or attempting unauthorised access to any account or system.

12. Fair housing

Every user must comply with applicable federal, state and local fair-housing and non-discrimination laws when listing, advertising, filtering, communicating or transacting through Own Ahead. See the fair housing policy.

13. Intellectual property

The Own Ahead name, logo, design, page layouts, editorial summaries, the Own Ahead Score methodology, software and compiled data are owned by the operator of Own Ahead or its licensors and are protected by intellectual property law. You may not copy, adapt or use them except as permitted by these terms. Rights holder complaints are handled through the copyright and takedown page.

14. Suspension and termination

We may suspend or terminate your access, remove content, or withdraw a claim approval if you breach these terms, if we reasonably suspect fraud, abuse or unlawful conduct, or if we need to protect the service or other users. You may stop using Own Ahead at any time and ask us to close your account. Provisions that should survive termination — including content licences already granted, disclaimers, liability limits and indemnity — continue to apply.

15. Disclaimer of warranties

To the maximum extent permitted by law, Own Ahead is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content. We do not warrant that the service will be uninterrupted, secure or error free. Nothing in these terms excludes or limits any warranty or right that cannot legally be excluded or limited, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

16. Limitation of liability

To the maximum extent permitted by law, Own Ahead and its operator, officers, employees and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunities, lost data, or costs arising from a property purchase, financing arrangement, failed closing or reliance on listing information. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service is limited to the greater of the amounts you paid Own Ahead in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars. These limits do not apply to liability that cannot lawfully be limited, including, where applicable, liability for death or personal injury caused by negligence or for fraud.

17. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold Own Ahead and its operator harmless from third-party claims, losses and reasonable costs arising from content you submit, from a listing or claim you make, from your breach of these terms or of applicable law, or from your conduct toward another user. This does not apply to the extent a claim results from our own breach or unlawful conduct, and we will give you notice of any claim and will not settle it in a way that imposes an obligation on you without your consent.

18. Service changes and events outside our control

We may add, change, suspend or discontinue features, listings, inventory sources or plans. We are not liable for delays or failures caused by events outside our reasonable control, including outages of our providers, network failures, natural events, civil disruption, or changes in law.

19. Governing law, disputes and contact

A governing law and venue are intentionally not stated in this version. They will be added once the operating entity and its counsel confirm them. We have not imposed mandatory arbitration or a class-action waiver, so nothing in these terms restricts your ability to bring a claim in a court that has jurisdiction, or to rely on the consumer protections available where you live.

Own Ahead does not yet publish a dedicated legal or privacy mailbox. Until one is in place, send any legal, privacy, accessibility, copyright or security message through the privacy and requests centre. Requests submitted there are logged for review, and you do not need an account to use it.
